An application for federal trademark registration can be made if you have never used the mark in the United States. You will be filing the application before the U.S. Patent and Trademark Office. After filing the application, the office will make a thorough search through the Trademark Electronic Search System (TESS) to determine if the mark that you wish to use is already registered to their database.
Once they have determined that the mark is not yet registered under any name or institutions, you will be given the right to use the mark within the marketing influence only but not the ownership rights of the product bearing the approved trademark. The ownership rights go with the patent.
Just like in patent application, there will be a federal trademark attorney who will review your application and issue the approval or rejection of your application. In case of the rejection, you will be given enough time to re-appeal your application. Then it will be either finally approved or finally rejected by the trademark attorney.
