The definition of a Private Investigator and a Private Detective varies by the rules and laws of the state in which they are licensed. Although people often interchange the terms 'private investigator' and 'private detective,' the trend has been moving toward 'private investigator.'
The reason for this is a logistical one. When shows like Magnum PI and others came out, law enforcement agencies felt the need to distinguish between a 'private detective' and a 'police detective.' Thus, the move toward the term 'private investigator.' In fact, in some states there is actually legislation for that very reason.
Some states have specific laws about these terms. As an example, in New Jersey those who want to become a private investigator are bound by the licensing laws detailed in the Private Detective Act of 1939. The person with the prerequisite investigative experience is called the qualifier. The license is actually issued by the New Jersey State Police Private Detective Unit, and that qualifier becomes classified as a 'Licensed Private Detective.' The owner of a licensed detective agency may hire registered employees who are termed 'Private Investigators.'
